Health-Related Information. Some information You provide (such as descriptions of Your hearing difficulty) may be considered health information or Consumer Health Data under certain state laws. We collect this information only when You voluntarily provide it, and We use it solely to assess Your suitability for Our hearing care services, schedule Your consultation, and provide You with appropriate product recommendations. We do not sell Consumer Health Data.

Usage Data Usage Data is collected automatically when using the Service and may include Your Device’s Internet Protocol (IP) address, browser type and version, the pages of Our Service You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers, and other diagnostic data. When You access the Service through a mobile device, We may automatically collect the type of mobile device You use, its unique ID, IP address, operating system, and mobile browser type.

  • To contact You: by telephone call, SMS/text message, email, or other equivalent forms of electronic communication regarding Your inquiry, appointment scheduling, consultations, and related service communications. Telephone and text communications are made only with Your prior express consent, as described in “Telephone and Text Communications (TCPA)” below.
  • For the performance of a contract: the development, compliance, and undertaking of the purchase contract for products or services You have purchased from Us.
  • To facilitate financing: if You choose to finance Your purchase, to connect You with Our financing partner (see “Financing” below).
  • To provide You with news, special offers, and general information about goods, services, and events We offer that are similar to those You have already purchased or inquired about, unless You have opted out.
  • To manage Your requests to Us.
  • For business transfers: to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets.

Financing

We offer financing options through Cherry Technologies, Inc. (“Cherry”). If You choose to apply for financing, You will provide Your information directly to Cherry, and Cherry’s own privacy policy and terms will govern its collection and use of Your information. We may share limited information with Cherry (such as Your name, contact details, and purchase amount) as necessary to facilitate Your financing application. We encourage You to review Cherry’s privacy policy at https://withcherry.com/privacy before applying.

Disclosure of Your Personal Data

We may share Your Personal Data in the following situations:

  • With Service Providers: to monitor and analyze use of Our Service, to contact You, to process payments, and to schedule appointments (for example, CRM, telephony, and analytics providers).
  • With Our hearing care professionals and partner clinics: licensed hearing care professionals in New York, New Jersey, and Massachusetts who conduct Your home-visit or clinic-visit evaluation and fitting.
  • With Our financing partner (Cherry): as described in “Financing” above, if You choose to apply for financing.
  • With advertising partners (Google, Meta): We may share identifiers and Usage Data with these platforms for advertising measurement and delivery. You may opt out as described below. We do not intentionally transmit Your health-related form answers to advertising platforms.
  • For business transfers: in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business.
  • With Affiliates: with Our parent company, subsidiaries, or entities under common control (including Ear Solutions Private Limited, India), who will be required to honor this Privacy Policy.
  • With Your consent: for any other purpose with Your consent.
  • Law enforcement and legal requirements: if required by law or valid requests by public authorities, or in the good-faith belief that such action is necessary to comply with a legal obligation, protect Our rights or property, prevent or investigate possible wrongdoing, protect the personal safety of users or the public, or protect against legal liability.

We do not sell Your Personal Information for money. Certain sharing with advertising platforms may qualify as a “sale” or “targeted advertising” under some state laws; You may opt out at any time (see below).

We may need to verify Your identity before fulfilling Your request. You may designate an authorized agent to submit requests on Your behalf where permitted by law. We will respond within the timeframe required by applicable law (generally 45 days, extendable where permitted). We will not discriminate against You for exercising Your privacy rights.

Opt-out preference signals: Where required by law, We honor browser-based opt-out preference signals such as Global Privacy Control (GPC).


Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as necessary for the purposes set out in this Privacy Policy and to comply with legal obligations, resolve disputes, and enforce Our agreements. Unless otherwise stated, the periods below are maximums, and We may delete or anonymize data sooner:

  • Lead and inquiry data: up to 24 months from Your last interaction with Us, unless You become a customer.
  • Customer account and purchase records: for the duration of the customer relationship plus up to 24 months, and longer where required for tax, warranty, or legal purposes.

  • Communication consent records (TCPA consent): retained as long as necessary to demonstrate compliance.

When retention periods expire, We securely delete or anonymize Personal Data. Residual copies may remain in encrypted backups for a limited period consistent with Our backup schedule and are not restored except where necessary for security, disaster recovery, or legal compliance.

Your information may be processed at the Company’s operating offices and in other locations where Our Service Providers or affiliates are located, which may include locations outside of Your state or country (including India, where Our affiliate Ear Solutions Private Limited operates). Our Service is intended for adults and does not address anyone under the age of 18. Notice Regarding Health Insurance

Ear Solutions Corp is a private-pay provider. We do not bill or participate in Medicare, Medicaid, or private insurance networks, and We are not a HIPAA “covered entity.” Health-related information You share with Us is protected as described in this Privacy Policy and applicable state consumer health data laws.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time.
